C.R. Bard and Huntington Surgeon Sued for Medical Malpractice

Aug. 3, 2010 - Huntington, W. Va. - Betty Adkins, of Cabell County is suing C.R. Bard and a surgeon in Huntington for medical malpractice.

According to WV Record, Adkins had surgery at St. Mary's Medical Center on November 26, 2007. Her surgeon, Mitchell E. Nutt, performed the surgery which included implantation of medical devices.

These medical devices, Avaulta Plus Anterior and Posterior BioSynthetic Support System, were implanted to treat her condition of pelvic organ prolapse. According to her West Virginia medical malpractice lawsuit, these devices were defective.

The surgeon is being sued for having implanted the defective devices. In addition, the victim is suing C.R. Bard, the company that was responsible for designing, manufacturing, marketing, packaging, labeling and selling the defective medical implant devices.

According to her West Virginia medical malpractice claim, these defective devices have resulted in emotional and physical pain and suffering, permanent injury and deformity and loss of a bodily organ.

The West Virginia medical malpractice lawsuit is based on the defendants being negligent on their part concerning the use and manufacturing of the defective medical devices. Adkins is seeking punitive and compensatory damages in her suit.
