West Virginia Truck Drivers and New Texting Law

You may be eligible to file a truck accident claim if you have been seriously injured in a West Virginia truck accident. Liability for a truck accident can extend beyond just the driver. In many cases the trucking company that employs the driver may also be found liable for your injuries.

West Virginia
Truck Drivers and New Texting Law

The Federal Motor Carrier Safety Administration (FMCSA) has passed a new texting law that affects West Virginia truck drivers. This new texting law goes into effect on October 21, 2010.

The FMCSA, as of October 21st, will prohibit texting by any Commercial Motor Vehicle (CMV) driver who is operating a truck in interstate commerce
. If a truck driver fails to abide by the new texting law it may result in civil penalties, imposing of sanctions and disqualification of the driver from operating CMVs in interstate commerce.

Texting while driving is just one example of negligence that can result in a serious or fatal West Virginia truck accident. Proving negligence on the part of the truck driver, trucking company, or any other party is the most basic and critical part of your accident claim. Working with an experienced truck accident lawyer can help you better understand any strengths or challenges in your case as well as help you gather valuable evidence to help establish the negligence of those responsible for your injuries.

You should talk to a Clarksburg truck accident lawyer if you have been injured in a West Virginia truck accident. They can not only help you determine the cause of the truck accident but determine the parties that may be at fault for your truck accident in West Virginia.
