New Rules Proposed for Surgeons to Disclose Sleep Deprivation

Medline Plus reports that new rules are being proposed that would require surgeons to disclose their own sleep deprivation to patients so that they can make an informed decision about the surgeon's ability to go forward.

These rules would allow surgeons to not only share with patients if they are suffering from fatigue but allow them to opt out of performing the surgery unless they receive a written consent from the patient.

Currently, the medical field has no rules or regulations concerning the amount of hours a surgeon can work.
This proposal would give them an opportunity to make a decision about their ability to work if they are sleep deprived.

Doctor fatigue is one of the reasons that some patients suffer from a mistake during surgery.
When a surgeon fails to get adequate sleep it can affect their ability to safely perform an operation and puts them at an increased risk of making a surgical error.

Giving patients the ability to make a decision about whether or not a surgeon performs on them could save them from complications that are a result of a mistake during surgery.

If you have suffered injuries due to a surgical error, you may be entitled to file a West Virginia medical malpractice claim. Consulting with a Shinnston injury attorney should be your next step to determine your legal rights.
