Defective Tree Stand Lawsuits

With hunting season just around the corner in West Virginia, many hunters will take advantage of the opportunity to use a tree stand, which puts them at a significant advantage in hunting. However, a defective tree stand poses a high risk of a hunter being involved in a tree stand accident.

Defective Tree Stand Product Liability Lawsuits

Injuries and deaths from a defective tree stand have resulted in product liability lawsuits in past cases. A relatively recent lawsuit occurred in early 2009 when a hunter lost his life using a defective tree stand that had detached from a tree. The hunter's widow was able to recover damages for her husband's wrongful death.

In 2008 a more well-known lawsuit took place against Ardisam, Inc., an equipment manufacturing company that was aware of a defect in one of its tree stand models but failed to issue a recall until 3 years later.
This was a direct violation against the Consumer Product Safety Act.

Rather than injured consumers filing a lawsuit, the Department of Justice's Office of Consumer Litigation filed the lawsuit and won $420,000 in civil penalties that had to be paid to the government.
In this lawsuit it was proven that many hunters had been injured by their defective tree stand.

Injuries from a tree stand accident in West Virginia may be the result of a defective tree stand. You should immediately contact a Clarksburg product liability attorney who can help determine if you are eligible to file a West Virginia product liability claim if you are hurt while using a defective tree stand or other faulty piece of hunting equipment.
