Buckhannon Man Charged Twice in ATV Accident

When it comes to operating all-terrain vehicles, West Virginia has instituted several laws in an effort to promote safety. Drivers who disobey these laws are subject to criminal penalties. One man who caused a West Virginia ATV accident found out the hard way after he was charged with a crime - twice.

Charge #1: ATV DUI

On June 22, 2010, Robert D. Williams was driving an ATV when he lost control and wrecked the vehicle around 6:15 p.m. The Upshur County Sheriff's Department says that subsequent blood alcohol tests indicated that the 29-year-old man was legally drunk at the time of the crash. Williams was charged with driving under the influence and released on a $75,000 bond.

Charge #2: ATV Child Neglect Causing Injuries

Though Williams wasn't injured in the accident, his 5-year-old son, who was a passenger on the ATV, had to be transported to a nearby hospital. As a result, Williams was arrested again later that week on a charge of child neglect causing injuries. He was arraigned and released on $20,000 bond along with instructions not to interact with the child without supervision.

Witnesses told police that on the day of the accident, Williams was driving the ATV at excessive speeds. They claim that his child passenger was not only helmetless, but was also sitting on the front of the ATV instead of the rider's seat. Officials say the boy has since been released from the hospital.

If convicted on both charges, Williams could receive several years in jail and thousands of dollars in fines.
